Introduction

The following Terms of Service outline your obligations when using the Shnack.com website. If you do not agree to the following terms, please do not use our web site. We reserve the right to limit or terminate your access to this site if you do not comply with these Terms of Service.

Member Conduct

As a condition of use, you agree to not use Shnack.com services for any purpose that is unlawful or prohibited by these Terms of Service, or any other purpose not reasonably intended by Shnack.com. Shnack.com members may not:

1. abuse, harass, threaten, impersonate or intimidate other Shnack.com members
2. post or transmit, or cause to be posted or transmitted, any Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party
3. post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any Shnack.com member
4. post any copyrighted material without the express permission of the copyright holder, unless such copyright is owned by you
5. create or submit unwanted email ("Spam") or messages to any other Shnack.com members
6. with the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission.
7. interfere with the operation of the Shnack.com site or cause a disproportionately large load on our infrastructure.
8. bypass any measures we may use to prevent or restrict access to the site
9. attempt to impersonate another user or person
10. infringe on Shnack.com's intellectual property

Accounts which are set up for the sole purpose of advertising a third-party commercial web site or service are not allowed. Accounts which are created to generate traffic to other commercial sites will be subject to deactivation.

User Content

You are solely responsible for the User Content you post or transmit and you agree not to post, transmit or otherwise publish through the Shnack.com any of the following:

1. User Content that is unlawful, defamatory, obscene, pornographic, indecent, lewd, sexually suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable or harmful, including without limitation photographs or other User Content containing nudity that would be unacceptable in a public museum where minors visit
2. User Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, endanger national security, or that would otherwise create liability or violate any local, state, national or international law
3. User Content that may infringe or violate any patent, trademark, trade secret, copyright or other intellectual or other proprietary right of any party
4. User Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity
5. Unsolicited promotions, political campaigning, advertising or solicitations
6. Private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers
7. Viruses, corrupted data or other harmful, disruptive or destructive files
8. User Content that, in the sole judgment of Shnack.com, is objectionable, harmful or which restricts or inhibits any other person from using or enjoying the Site, or which may expose Shnack.com or its users to any harm or liability of any nature.

Although we prohibit certain activities in these Terms of Use, Shnack.com does not control and takes no responsibility or liability for any User Content or for any loss or damage thereto, or for the nature of the User Content you may encounter. Your use of the Site is at your own risk.

Your Account

Certain activities on the Site require you to register and create an account. By registering, you represent and warrant that all information you provide in the registration form is complete and accurate. Shnack.com reserves the right to refuse service to anyone at any time, with or without cause in its sole discretion. You agree to keep your registered email addresses and other Registration Data current and complete, as Shnack.com may send important notices about your account or the Services to that email account.

Your Username may be displayed on various pages of our site and is therefore available to the public. Activity on our site is traceable to your User ID or Username. Other people can see your albums (unless you choose to make them private), comments, profile page, and so on.

Your account password is the key to your account. We recommend you use unique numbers, letters and special characters, and do not disclose your Shnack.com account password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify Shnack.com and change your password.

Security

Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use many tools (encryption, passwords, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not guarantee that your personal information or private communications will always remain private.

Collection of Information

You can browse our site without telling us who you are or revealing any personal information about yourself. Once you register and give us your personal information, you are not anonymous to us. General Information

Shnack.com reserves the right to delete inactive accounts or accounts that have not been used for a significant amount of time

Shnack.com cannot guarantee site up-time or that we will be around forever to display your listings, but we will do our best to ensure the site is running as smooth as possible with the least amount of down-time.

All information and services offered through Shnack.com are provided "as-is" and "as-available" without warranty of any kind. Shnack.com will not be held liable for any damages of any kind that may result from the use of, or the inability to use, the site or any content or materials through the site.
